Trust Document Notarization — Remote Online, Florida
Multi-signer trust packages — settlor, trustees, and witnesses — notarized in one secure video session. Attorneys draft the trust; EMC notarizes and coordinates the signing.
Trust Document Notarization is a secure video notarization service for attorney-drafted trust instruments, trustee oaths, certifications of trust, and the deeds that fund a trust with real property. EMC notarizes and coordinates the signing — we do not draft trusts or give legal advice.
What EMC does — and does not — do
EMC Remote Notary notarizes and streamlines trust signings and document workflows. Attorney-drafted trust documents are welcome and expected — we don't prepare trusts, draft trust language, or advise which provisions to include. That's the unauthorized practice of law when done by a notary.
I am not an attorney licensed to practice law in the State of Florida, and I may not give legal advice or accept fees for legal advice.
What we notarize
- Declarations of Trust & Trust Instruments — acknowledgment for the settlor and each trustee named in the instrument.
- Trustee Oaths & Acceptances — jurat where required, with witnesses arranged for the session when the document calls for them.
- Certification of Trust — statutory certification of trust existence and authority (F.S. §736.1017).
- Deeds Funding a Trust — property transfers into the trust, with Florida's two-witness requirement for real property handled in-session (F.S. §689.01).
- Florida Secretary of State trust filing affidavits — affidavits filed in connection with Florida trust filings (F.S. ch. 609).
How it works
Send your documents securely. An AI-assisted pre-check flags blank fields, missing signers, or unmet witness requirements before the session is scheduled.
Everyone gets a signing link. Each settlor, trustee, and witness receives their own email link. Same-device sessions are supported, and witnesses can join remotely or be provided.
Identity verification and live video signing. Each signer completes identity verification, then signs live on video under the notary's electronic seal.
Receive your completed package. The finished notarized package and session receipt are delivered directly to you.
Why sign your trust package with EMC
- AI-assisted document pre-check — every trust package is scanned before the session for blank parties, name mismatches against ID, and missing witness counts, the leading cause of failed identity verification.
- Bilingual service — sessions available in English and Spanish.
- Evening availability — appointments available outside standard business hours.
Compliance & legal framework
- Remote Online Notarization is performed under Florida Statutes Chapter 117, Part II.
- Acknowledgment vs. jurat: an acknowledgment confirms the signer's identity and voluntary signature; a jurat additionally requires the signer to swear to the document's contents.
- Witnesses must be physically located in the United States.
Frequently asked questions
Can a notary prepare my trust?
No. Preparing or drafting a trust is the practice of law and requires a licensed attorney. EMC Notary notarizes and coordinates the signing of attorney-drafted trust documents — we do not draft trusts or give legal advice.
How many witnesses does a trust need in Florida?
It depends on the document. The trust instrument itself generally requires no witnesses for notarization. A deed conveying Florida real property into the trust requires two subscribing witnesses (F.S. §689.01). A trustee oath's witness requirement follows the terms of that specific document.
Can multiple signers share one device?
Yes. Same-device sessions are supported with a designated host managing the handoff between signers.
What ID is required?
A current, government-issued photo ID for every signer. The name on the ID must match the name on the document — this is the single most common cause of a failed verification, which is why the pre-check flags mismatches before the session.
How long does a session take?
A single-document, single-signer session typically runs 15-30 minutes. Multi-signer trust packages take longer depending on the number of parties and documents.
What does it cost?
A single trust-related document is priced like any RON session: the itemized notarial act (Florida's RON cap, F.S. §117.275) plus the service and coordination fee — see /pricing for the current rates. Multi-document, multi-signer trust packages, similar in scope to our Premium Legacy & Estate Services, are quoted before booking once we know the document and signer count; send your documents for a free pre-check and quote.
